The Madras High Court has directed the Tamil Nadu government that transgenders should be treated as a special category irrespective of their caste and should not be lumped into the female or male category for education and employment.

While passing the order, Justice V. Bhavani Subbarayan said that the government will set separate criteria for transgenders in employment and education opportunities. The government will direct all state recruitment agencies to give special category to the third gender and set separate criteria for their cut-off marks. The judge made it clear that in future transgenders will never be placed in the male or female category.

Court's decision came on TNPSC case

Allowing the plea of ​​a transgender named R. Anushree, the judge said that since the petitioner has secured the eligible cut-off marks, the Tamil Nadu Public Service Commission will allow the petitioner to upload documents for certificate verification.

The judge said that the petitioner has been placed in the Scheduled Caste women category. In view of this, the Tamil Nadu Public Service Commission (TNPSC) has not allowed her to upload her certificate for verification, as she has scored less marks than the cut-off set for Scheduled Caste women. It is worth noting that the Supreme Court has clearly stated that transgenders should not be considered one between men and women.
