Many times the study permit is also rejected because either the students do not submit any documents or they do not comply with the conditions to study in Canada. Actually, a new project has been started in Canada, which is going to be very beneficial for those students including Indians who have faced visa rejection. From October 1, the Federal Court of Canada is starting the 'Study Permit Pilot Project'. According to CIC News report, this project is for those people whose study permit has been rejected and they want to get it re-reviewed by the court.

How is Canada's new project beneficial for students?

If a student's study permit is refused, they can apply for 'Leave and Judicial Review' through the 'Study Permit Pilot Project'. Currently the entire process of 'vacation and judicial review' takes 14-18 months, but now the entire process can be completed in less than 5 months. 'Leave and judicial review' means that the student is asking the Federal Court of Canada for permission to reconsider their application.

Usually the judge first decides whether the student (applicant) should be granted leave or not. If permission is granted, the judge reviews your case and makes a decision. But under this new project both 'Leave' and 'Judicial Review' will be seen together. There is no additional fee to join this project. However, the fee for applying for 'Leave and Judicial Review' is $50.

Who is eligible under the new project?

Under the 'Leave and Judicial Review' project, only students who have applied for a study permit and have now received a rejection letter from 'Immigration, Refugees and Citizenship Canada' (IRCC) can apply. Apart from this there are some other conditions also, which are as follows:

  • Both the applicant and IRCC must agree to participate in the project.
  • Both parties must agree on the facts of the case as reflected in the documents submitted by the applicant to IRCC.
  • The matter should be straightforward and simple, with no complications such as national security issues or misinformation.
  • Applicants should not request extension of the last date of application.
  • There is no need for any kind of affidavit in this new project.

If any student is applying from Canada then he/she must submit his/her application under this new project within 15 days of receiving the rejection letter. If a student is applying from outside Canada, he or she will have 60 days to apply.

how to apply?

All documents will have to be sent online, for which the court's e-filing system will be used. To join this project, you must apply for leave and judicial review using Form IR-1. Also, you will have to mention the pilot project at three places in your application. After submitting the documents, the judge will make a decision on your application and inform you.
