No decision could be taken in the court on the release of Kangana Ranaut's film 'Emergency' even on Thursday. While the Bombay High Court has directed the Censor Board to take a decision on the release of the film before September 25, an interesting incident also took place in the court during the hearing. The co-producers of the controversial film 'Emergency' told the High Court on Thursday that BJP MP Kangana Ranaut's film is being prevented from releasing at the behest of her own Bharatiya Janata Party. A bench of Justices Burgess Colabawala and Firdaus Pooniwala was told that the Central Board of Film Certification (CBFC) is protecting its 'interests' at the behest of the ruling party (BJP), as the film is being considered 'anti-Sikh'. Arguing on behalf of the film's producer Zee Studios, senior advocate Venkatesh Dhond said that the Censor Board is deliberately delaying the release of the film.
The court said- So will the film influence votes in the elections?
Advocate Dhond told the court, “The co-producer of the film Kangana Ranaut is a BJP MP and her party does not want a film made by one of its members to be released now, which hurts the sentiments of certain communities.” To this, Justice Colabawala replied, “So you mean this will affect the voting decision of people who vote for the BJP? Why would a person ruling a state want to stop a film made by one of its members? If there was any other opposition party in the state, we could have considered it.”

The lawyer said- the censor board is working on instructions
During the hearing, lawyer Dhond also presented arguments about the objections of the Sikh community to the film. He mentioned the objections raised over the portrayal of the community leader in the film and said that this is the reason why the censor board is shying away from taking a decision on the release of the film. On this, Justice Colabawala asked whether the CBFC is working on behalf of someone else instead of the central government?
Giving his own example, the judge said- why and how people get influenced by the film
Justice Colabawala also asked how and why people are affected by such portrayals in films? The Justice, who himself comes from the Parsi community, said, 'My community is mocked in almost every film. We laugh and do not believe that it is against our community.'

In the court, the producers blamed the central government for the delay in the release. Lawyer Dhond said, 'Your Excellency, I can say that all this is happening at the behest of the ruling party at the Center. They are looking at their overall interests and therefore do not want this film to be released.' On this, Justice Colabawala quipped and asked whether this means that the ruling party at the Center is working against its own MP? So Dhond replied that the film's co-producer and MP Ranaut has been asked to 'maintain discipline', but he does not want to talk much about it.
The court said- without watching the film how can people understand that it is against the law
During the hearing, the bench of judges seemed upset with the arguments of lawyer Dr. Abhinav Chandrachud, who appeared on behalf of the censor board. The judges criticized the attitude of the censor board and questioned how people conclude that a film is against their community without watching the film? The bench said, 'This is not a documentary … Do you think that the people of our country are so naive that they will believe whatever is shown in the film? What about creative freedom? There are billions of internet users in our country … This issue of objecting to the release of films should stop, otherwise what will happen to creative freedom and freedom of expression in our country? We are only limiting creative freedom.'
Censor board reprimanded – take a decision on the release by September 25
At the end of the hearing, the bench asked the censor board to decide by September 25 whether the film will be released or not. Justice Colabawala, while adjourning the case for further hearing, said, 'Do whatever you want to do, but you have to take a decision by September 25. You decide. Also have the courage to say that the film should not be released. Then we will appreciate the stance of the censor board. Do not remain in uncertainty.'
