AAP’s Kuldeep Kumar Declared Winner in Chandigarh Mayor Election, SC Orders Prosecution of RO Anil Masih

In a significant development, the Supreme Court has declared the Aam Aadmi Party (AAP) candidate, Kuldeep Kumar, as the validly elected Mayor of Chandigarh Municipal Corporation, overturning the controversial result of the previous election. The court ordered the prosecution of Returning Officer Anil Masih for misdemeanour in connection with the alleged tampering of eight AAP votes.

The Supreme Court bench, led by Chief Justice of India DY Chandrachud, stated, “The petitioner is declared to be the validly elected candidate for the post of Mayor of Chandigarh Municipal Corporation.” The court emphasized that counting the eight votes as valid would make the petitioner secure 20 votes.

Regarding Anil Masih, the court ordered prosecution, noting, “Firstly, he has unlawfully altered the course of Mayoral election. Secondly, in making a solemn statement before this Court on 19 February, the Presiding Officer expressed falsehood for which he must be held accountable.”

The controversy arose when the BJP won the Chandigarh mayoral poll, defeating the AAP-Congress alliance candidate, after the returning officer declared eight votes invalid. The video evidence presented in the Supreme Court showed Anil Masih marking the eight ballots as invalid.

This ruling by the Supreme Court nullifies the previous election result and establishes Kuldeep Kumar as the rightful winner of the Chandigarh mayoral polls.
